Privacy Notice

Introduction

This Privacy Notice (“Privacy Notice”) describes the types of information Everkind Labs, Inc. (“Everkind,” “we,” “us,” “our”) collects, uses, maintains, protects, discloses, or otherwise processes about you when:

• You visit our website at https://everkind.app (“Website”);
• You install and use our mobile applications (“Application”);
• You use our products and services (“Services”);
• You communicate with us via email, text, or other medium; and
• We interact with certain third parties.

Everkind is a relationship assistant. You tell us about the people who matter to you, and we use that information, including with the help of artificial intelligence, to give you thoughtful insights, gentle reminders, and personalized suggestions that help you show up for the people in your life. Our in-app AI assistant (“Jules”) is a tool to help you understand and nurture your real-world relationships; it is software, not a person, and it is not a substitute for human connection or professional care. Because so much of what you share with us is personal, we have tried to write this Privacy Notice plainly. Please read it carefully.

Unless otherwise noted, the term “Personal Data” means information that identifies, relates to, or could reasonably be linked with you or another identifiable person. It does not include deidentified or aggregated information.

The Short Version

We know this notice is long, so here is what matters most:

• We do not sell your Personal Data, and we never share the relationship information you record, such as your contacts, your notes, your conversations, or the insights we generate, with advertisers or other third parties for their own purposes.
• We use Google’s Gemini AI to turn the information you provide into insights and suggestions. Google processes this data on our behalf to return results to us.
• The information you record about other people is stored privately in your account and is used only to power your experience.
• We do not currently show ads or use advertising trackers. We do use analytics and diagnostics tools (such as Google Analytics for Firebase) that collect device and usage data to help us operate and improve the Services. We explain this below, and you can opt out.
• You can delete your account, and the data in it, at any time from within the app.

Information We Collect

We collect Personal Data from several sources, including:

• Directly from you when you provide it to us;
• Automatically as you navigate through or otherwise use the Website, Applications, and Services;
• Information that we, including our automated and AI systems, create or infer about you and your relationships as you use the Services; and
• From third parties, for example, service integrations you decide to add.

Information You Provide to Us

We collect the following types of Personal Data directly from you when you create an account or use the Services:

• Account and identity details, such as your name, email address, and account name;
• Profile details you choose to add, such as your pronouns, birthday, city, and time zone;
• Your preferences and settings, including notification and reminder choices; and
• Any other information you provide when communicating with us, requesting support, or using integrations.

Information You Provide About Other People

The heart of Everkind is helping you stay close to the people you care about, so you will provide information about other people, such as your friends, family, and colleagues (your “Contacts”). This may include their names, pronouns, birthdays, relationship to you, interests, and the notes, memories, events, and details you record about your relationship with them. Our AI may also generate summaries or inferences about your Contacts based on what you tell us.

We treat this information with the same care as your own. We store it privately in your account and use it only to provide the Services to you. We do not sell it, and we do not share it with advertisers. You are responsible for the information you record about other people, and you represent that you have any rights or permissions needed to provide it. If one of your Contacts asks us to access or delete information you have stored about them, please contact us at privacy@everkind.app and we will work with you to respond appropriately.

Content and Conversations You Create

When you write notes, complete check-ins, answer prompts, journal, or have a conversation with our in-app AI assistant, we collect and store that content so we can provide and personalize the Services. Some of this content reflects your feelings, moods, and the state of your relationships.

Voice Interactions

Some features let you speak with our in-app AI assistant. When you use voice, your speech is processed in real time so we can understand you and respond, and we use third-party voice infrastructure (such as LiveKit for real-time sessions and a text-to-speech provider to generate spoken replies). We store the text transcript of these conversations as part of your account. We do not retain copies of the raw audio after a session ends.

Subscription and Purchase Information

If you purchase a subscription, that transaction is processed by the Apple App Store and managed through our subscription provider, RevenueCat. We receive your subscription status, plan, and related entitlement information. We do not receive or store your full payment card number.

Information Collected Automatically

As you navigate through and interact with our Website, Applications, and Services, we and our service providers may use automatic data collection technologies to collect certain information, including:

• Details of your visits to, and use of, our Website, Applications, and Services, including usage and interaction data, traffic data, and clickstream data;
• Information about your device and internet connection, including your IP address, device identifiers, operating system, and browser type; and
• Approximate location derived from your IP address.

The technologies we use for this automatic data collection may include cookies, web beacons, software development kits (SDKs), and analytics and performance-monitoring tools.

Location Information

With your permission, the Application may access your device location to provide location-aware features, such as weather and locally relevant suggestions. You can grant or revoke location permission at any time in your device settings.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Data:

• To provide, operate, and personalize our Applications and Services to you;
• To generate insights, reminders, suggestions, and other content using artificial intelligence (see “Artificial Intelligence and Automated Processing” below);
• To provide you with information, products, or services that you request from us;
• To support, develop, troubleshoot, and debug our products and services;
• To create, maintain, customize, and secure your account with us;
• To process your requests, purchases, and transactions;
• To send you notifications and reminders you have enabled;
• To help maintain the safety, security, and integrity of our Services;
• For internal testing, research, analysis, and product development;
• To measure and improve our Services, including through analytics;
• To detect security incidents and protect against malicious or illegal activity;
• To carry out our obligations and enforce our rights; and
• For any other purpose with your consent.

Artificial Intelligence and Automated Processing

Everkind uses artificial intelligence to deliver its core features. The information you provide about yourself and your Contacts is processed by AI models, including Google’s Gemini models, to generate summaries, insights, suggested messages, reminders, and similar content. This processing is automated and involves analyzing and making inferences about you and your relationships.

Google processes this data as our service provider in order to return results to us. We do not use your Personal Data to serve you advertisements, and we do not sell it. AI-generated content can be inaccurate or incomplete, and it is intended to support your own judgment, not to replace professional advice. You remain responsible for how you act on the suggestions the Services provide.

How We Share Your Information

We do not sell your Personal Data, and we do not share the relationship information you record, such as your Contacts, notes, conversations, and the insights we generate, with third parties for their own purposes. We share information only in the limited circumstances described below.

Service Providers

We share information with trusted companies that process it on our behalf, under contract and only to provide services to us. These include:

• Cloud hosting and infrastructure, including Google Firebase and Google Cloud, where your data is stored and processed;
• Artificial intelligence processing, including Google (Gemini), which generates insights and content from the information you provide;
• Voice infrastructure, including LiveKit and our text-to-speech provider, which power real-time and spoken interactions;
• Subscription and purchase management, including Apple and RevenueCat;
• Analytics, diagnostics, and crash reporting, including Google Analytics for Firebase and related Google tools.

Other Disclosures

We may also disclose Personal Data:

• To our subsidiaries and affiliates;
• To a buyer or successor in the event of a merger, divestiture, financing, or other transfer of some or all of our business or assets;
• To comply with any court order, law, or legal process, including to respond to a government or regulatory request;
• To enforce our Terms of Service and other agreements; and
• If we believe disclosure is necessary to protect the rights, property, or safety of Everkind, our users, or others.

Advertising and Analytics

We use analytics and diagnostics tools, including Google Analytics for Firebase and crash reporting, to understand how the Services are used and to improve them.

We do not currently display advertisements in the Services, and we do not use advertising trackers or share information with advertising networks. We previously integrated an advertising component (Google AdMob), but it is disabled and does not run or collect data. If we decide to offer an ad-supported plan in the future, we will update this Privacy Notice and provide any notices or choices required by law before we begin.

The analytics and diagnostics tools we use are provided by third parties whose software runs inside our Application and collects certain information directly from your device, even though we do not hand them the information you record about yourself or your Contacts. The information these tools may collect includes app and device identifiers, IP address and approximate location, device and operating-system details, and information about how you interact with our Application. Google uses this information to provide analytics and related services in accordance with Google’s own policies.

Because analytics providers may receive identifiers from your device, some laws may treat this as “sharing” or a “sale” of Personal Data, even though no money is exchanged for your information. You can limit or opt out of this in several ways:

• On iOS, decline tracking when prompted by App Tracking Transparency, or turn off “Allow Apps to Request to Track” in your device settings;
• Reset or limit your device advertising identifier in your device privacy settings; and
• Email us at privacy@everkind.app to request that we treat your data as opted out of sharing.

Your Privacy Choices and Rights

You can review and change much of your Personal Data by logging into the Application and visiting your account and profile settings. You can also delete your account and its data directly in the app (see “Data Retention and Deletion” below). To make other requests about your Personal Data, email us at privacy@everkind.app.

Depending on where you live, you may have the right to:

• Access or receive a copy of the Personal Data we hold about you;
• Correct inaccurate Personal Data;
• Delete your Personal Data;
• Opt out of the sharing of your Personal Data for targeted advertising; and
• Withdraw consent where we rely on it.

California Residents

If you are a California resident, the California Consumer Privacy Act, as amended, gives you rights to know, access, correct, and delete the Personal Data we collect, and to opt out of its “sale” or “sharing.” We do not sell your Personal Data, and we do not currently use it for advertising. As described in “Advertising and Analytics” above, our use of analytics tools may be considered “sharing” under some laws, and you can opt out using the methods listed there or by emailing privacy@everkind.app. Some information you provide, such as details about your relationships and emotional state, may be considered sensitive Personal Data, and we use it only to provide the Services to you. We will not discriminate against you for exercising your rights.

European Economic Area, United Kingdom, and Similar Jurisdictions

If you are located in a jurisdiction with comprehensive data protection law, we process your Personal Data on the legal bases of performing our contract with you, your consent, our legitimate interests in operating and improving the Services, and compliance with our legal obligations. You may have rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your local data protection authority. Data Retention and Deletion

We keep your Personal Data for as long as your account is active or as needed to provide the Services to you. You can delete your account at any time from within the Application’s settings. When you do, we begin deleting your account and remove your data from active use, and we permanently delete it after a short recovery period of approximately 30 days, after which conversations, transcripts, notification logs, and the information about your Contacts are purged.

We may retain certain records for longer where required to comply with legal, accounting, or security obligations, or to resolve disputes. For example, subscription and billing records managed by our payment providers may be retained by them in accordance with their own policies. You may also email privacy@everkind.app to request deletion of your Personal Data.

Age Requirement; Minors

The Services are intended only for adults aged 18 and older, and our sign-up process is designed to prevent people under 18 from creating an account. We do not direct the Services to children, and we do not knowingly collect Personal Data from anyone under 18. If we learn that we have collected Personal Data from a person under 18, or from a child under 13 without verifiable parental consent, we will delete that information. If you believe a minor has provided us Personal Data, please contact us at privacy@everkind.app.

Choices About Cookies

You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.

Do Not Track Signals

Some web browsers may transmit “do not track” signals. We currently do not take action in response to these signals, as no uniform technology standard for recognizing and implementing these signals has been established.

Data Security

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure, including encryption in transit and access controls. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access, you are responsible for keeping this password confidential.

Consent to Processing in the United States

If you are accessing our Services from outside the United States, please be advised that your information may be transferred to, stored, and processed in the United States and other countries where we or our service providers operate, where data-protection laws may differ from those in your country.

Changes to Our Privacy Notice

It is our policy to post any changes we make to our Privacy Notice on this page. If we make material changes to how we treat our users’ Personal Data, we will notify you through a notice on the Website and/or Application. The date the Privacy Notice was last revised is identified at the top of the page.
